Thank you for using The Beck

These Terms of Service (“Terms”) govern your access to and use of The Beck Website, apps, APIs, and widgets (“The Beck” or the “Service”). Please read these Terms carefully, and contact us if you have any questions. By accessing or using The Beck, you agree to be bound by these Terms, our Privacy Policy, our Cookies Policy and our Community Guidelines.

Our Service

The Beck helps you discover local information in your community. We do our best to provide you with information that is accurate and relevant, and interesting. To do that, we show you things we think will be relevant, interesting and personal to you based on your onsite and offsite activity. Some of the content we display on our website are promoted by advertisers. As part of our service we try to ensure that even promoted content is local and relevant and valuable to you.

Using The Beck

Who Can Use The Beck

As advertisers, Either Beck Businesses or Beck Sponsors, you may use The Beck only if you can legally form a binding contract with The Beck, and only in compliance with these Terms and all applicable laws. When you create your Beck account, you must provide accurate and complete information. Any use or access by anyone under the age of 13 is not allowed.  You are wholly responsible for the content that you upload to The Beck, and agree to follow our advertising guidelines on all of your advertisements.  Failure to follow these guidelines may result in a permanent suspension of The Beck services.

Our License To You

Subject to these Terms and our policies (including our Guidelines), we grant you a limited, non-exclusive, non-transferable, and revocable license to use our Service.

Commercial use of The Beck

If you want to use The Beck for commercial purposes you must create a business account and agree to our Business Terms of Service. If you do open an account for a company, organization, or other entity, then “you” includes you and that entity, and you promise that you are authorized to grant all permissions and licenses provided in these Terms and bind the entity to these Terms, and that you agree to these Terms on the entity’s behalf.

Your Content

Posting Content

The Beck allows you to post content, including photos, comments, announcement, links, and other materials. Anything that you post or otherwise make available on The Beck is referred to as “User Content.” You retain all rights in, and are solely responsible for, the User Content you post to Pinterest.

How The Beck and other users can use your content

You grant The Beck and our users a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, store, display, reproduce, save, modify, create derivative works, perform, and distribute your User Content on The Beck solely for the purposes of operating, developing, providing, and using The Beck. Nothing in these Terms restricts other legal rights The Beck may have to User Content, for example under other licenses. We reserve the right to remove or modify User Content, or change the way it’s used in The Beck, for any reason. This includes User Content that we believe violates these Terms, our Community Guidelines, or any other policies.

How long we keep your content

Following termination or deactivation of your account, or if you remove any User Content from The Beck, we may keep your User Content for a reasonable period of time for backup, archival, or audit purposes. The Beck and its users may retain and continue to use, store, display, reproduce, perform, and distribute any of your User Content that other users have stored or shared on The Beck.

Feedback you provide

We value hearing from our users, and are always interested in learning about ways we can make The Beck more awesome. If you choose to submit comments, ideas or feedback, you agree that we are free to use them without any restriction or compensation to you. By accepting your submission, The Beck doesn’t waive any rights to use similar or related feedback previously known to The Beck, or developed by its employees, or obtained from sources other than you.

We care about the security of our users. While we work to protect the security of your content and account, The Beck can’t guarantee that unauthorized third parties won’t be able to defeat our security measures. We ask that you keep your password secure. Please notify us immediately of any compromise or unauthorized use of your account.

Third party links, sites, and services

The Beck may contain links to third party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by The Beck. We don’t endorse or assume any responsibility for any such third party sites, information, materials, products, or services. If you access any third party website, service, or content from The Beck, you do so at your own risk and you agree that The Beck has no liability arising from your use of or access to any third party website, service, or content.

The Beck may terminate or suspend your right to access or use The Beck for any reason on appropriate notice. We may terminate or suspend your access immediately and without notice if we have a good reason, including any violation of our Community Guidelines. Upon termination, you continue to be bound by the above sections of these Terms.

If you use The Beck for commercial purposes (i.e., you are not a consumer) without agreeing to our Business Terms as required by Section 2 of these Terms, you agree to indemnify and hold harmless The Beck, their affiliates and their respective officers, directors, employees and agents, from and against any claims, suits, proceedings, disputes, demands, liabilities, damages, losses, costs and expenses, including, without limitation, reasonable legal and accounting fees (including costs of defense of claims, suits or proceedings brought by third parties), in any way related to your access to or use of our Service, your User Content, or your breach of any of these Terms.

Our Service and all content on The Beck is provided on an “as is” basis without warranty of any kind, whether express or implied.

The Beck specifically disclaims any and all warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement, and any warranties arising out of course of dealing or usage of trade.

The Beck takes no responsibility and assumes no liability for any User Content that you or any other person or third party posts or sends using our Service. You understand and agree that you may be exposed to User Content that’s inaccurate, objectionable, inappropriate for children, or otherwise unsuited to your purpose.

Limitation of liability

For any dispute you have with The Beck, you agree to first contact us and try to resolve the dispute with us informally. If we need to contact you, we will do so at the email address on your The Beck account. If The Beck hasn’t been able to resolve the dispute with you informally, we each agree to resolve any claim, dispute, or controversy (excluding claims for injunctive or other equitable relief) arising out of or in connection with or relating to these Terms through binding arbitration or (for qualifying claims) in small claims court.

Arbitration is a more informal way to resolve our disagreements than a lawsuit in court. For instance, arbitration uses a neutral arbitrator instead of a judge or jury, involves more limited discovery, and is subject to very limited review by courts. Although the process is more informal, arbitrators can award the same damages and relief that a court can award. You agree that, by agreeing to these Terms of Service, and that you and The Beck are each waiving the right to a trial by jury or to participate in a class action. The arbitrator has exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this binding arbitration agreement. This arbitration provision shall survive termination of this Agreement and the termination of your The Beck account.

NOTHING IN THESE TERMS OF SERVICE SHALL AFFECT ANY NON-WAIVABLE STATUTORY RIGHTS THAT APPLY TO YOU. To the extent any claim, dispute or controversy regarding The Beck or our Service isn’t arbitrable under applicable laws or otherwise: you and The Beck both agree that any claim or dispute regarding The Beck will be resolved exclusively in accordance with the above Section of these Terms.

Governing law and jurisdiction

These Terms shall be governed by the Canadian Law

General Terms

We reserve the right to determine the form and means of providing notifications to you, and you agree to receive legal notices electronically if that’s what we decide. We may revise these Terms from time to time and the most current version will always be posted on our website. If a revision, in our discretion, is material, we’ll notify you. By continuing to access or use The Beck after revisions become effective, you agree to be bound by the new Terms. If you don’t agree to the new terms, please stop using The Beck.

These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by The Beck without restriction. Any attempted transfer or assignment in violation hereof shall be null and void.

Entire agreement/severability

These Terms, together with the Privacy Policy and any amendments and any additional agreements you may enter into with The Beck shall constitute the entire agreement between you and The Beck concerning the Service. If any provision of these Terms is deemed invalid, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Pinterest’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Thank you for using The Beck!

Our mission is to help you discover the communities around you!  To do that, we show you personalized content and ads we think you’ll be interested in based on information we collect from you and third parties. We only use that information where we have a proper legal basis for doing so.

We wrote this policy to help you understand what information we collect, how we use it and what choices you have about it. Because we’re an internet company, some of the concepts below are a little technical, but we’ve tried our best to explain things in a simple and clear way.

We collect information in a few different ways:

When you give it to us or give us permission to obtain it

When you sign up for or use The Beck, you give us certain information voluntarily. This includes your name, email address, phone number, profile photo, comments, and any other information you give us. You can also choose to share with us location data or photos. If you buy something on The Beck, we collect payment information, contact information (address and phone number) and details of what you bought. If you buy something for someone else on The Beck, we collect their delivery details and contact information.

If you link your Facebook or Google account or accounts from other third party services to The Beck, we also get information from those accounts (such as your friends or contacts). The information we get from those services depends on your settings and their privacy policies, so please check what those are.

We also get technical information when you use The Beck

Whenever you use any website, mobile application or other internet service, certain information gets created and logged automatically. The same is true when you use The Beck.  Here are some of the types of information we collect:

  • Log data. When you use The Beck, our servers record information (“log data”), including information that your browser automatically sends whenever you visit a website, or that your mobile app automatically sends when you’re using it. This log data includes your Internet Protocol address, the address of and activity on websites you visit that incorporate The Beck features (like the “Save” button—more details below), searches, browser type and settings, the date and time of your request, how you used The Beck, cookie data and device data.
  • Cookie data.  We also use “cookies” (small text files sent by your computer each time you visit our website, unique to your The Beck account or your browser) or similar technologies to capture log data. When we use cookies or other similar technologies, we use session cookies (that last until you close your browser) or persistent cookies (that last until you or your browser delete them). For example, we use cookies to store your language preferences or other settings so you don‘t have to set them up every time you visit The Beck. Some of the cookies we use are associated with your The Beck account (including information about you, such as the email address you gave us) and other cookies are not.
  • Device information. In addition to log data, we collect information about the device you’re using The Beck on, including type of device, operating system, settings, unique device identifiers and crash data that helps us understand when something breaks. Whether we collect some or all of this information often depends on what type of device you’re using and its settings. For example, different types of information are available depending on whether you’re using a Mac or a PC, or an iPhone or Android phone. To learn more about what information your device makes available to us, please also check the policies of your device manufacturer or software provider.

Our partners and advertisers share information with us

We also get information about you and your activity outside The Beck from our affiliates, advertisers, partners and other third parties we work with, or other publicly available sources. For example:

  • Online advertisers or third parties share information with us to measure or improve the performance of ads on The Beck, or to figure out what kinds of ads to show you. This includes information about your visits to an advertiser’s site or purchases you made from them, or information about your interests from a third party service, which we might use to help show you ads.

What we do with the info we collect:

We use the information we collect to provide the Service to you. We commit to showing you content that’s relevant, interesting and personal to you. In order to do that, it’s necessary for us to use your information to:

  • Identify you when you use The Beck, and process your transactions.
  • Recommend categories you might like based on your activity on The Beck. For example, if we see you’re into browsing salons, we may suggest a highly rated salon
  • Respond to your questions or comments.

In addition and for similar reasons, we have a legitimate interest in using your information in these ways. It is also fundamental to the nature of the Service we provide. In short, it’s necessary for us to do these things in order to make the Service relevant, interesting and personal to you like we promised, and it’s in both of our interests for us to do that.

We also have a legitimate interest to improve The Beck, maintain our relationship with you, and protect users. We both benefit when we use your information to:

  • Conduct analytics on who is using The Beck and what they are doing. For example, by logging how often people use two different versions of a feature on The Beck, we can understand which version is better.

  • Improve The Beck and offer new features.

  • Send you updates (such as when certain activity, like saves or comments, happens on The Beck) and news by email or push notification, depending on your settings. For example, we send weekly updates that include New Sales you may like. You can decide to stop getting these notifications by updating your settings .

We have a legitimate interest in delivering ads that are relevant, interesting and personal to you in order to generate revenue (providing this Service is expensive!) To further these interests we use the information we collect to:

  • Decide which ads to show you. For example, if you show an interest in camping tents on The Beck, we may show you ads for other outdoor products. We customize the ad content we show you by identifying your interests based on your onsite and offsite activities, as well as by using information we receive from ad partners or other third parties. Where we use cookies to identify your offsite interests, we will obtain consent where required as described in more detail below. Where ad partners or other third parties share information with us about you, we rely on the consent they have obtained.

  • Tell our ad partners how their The Beck ads are doing, and how to make them better. Some of this information is aggregated. For example, we would report to an advertiser that a certain percentage of people who viewed a Promoted Ad went on to visit that advertiser’s site. In other instances, this information isn’t aggregated. For example, we would let an advertiser know that a particular Promoted Ad has been saved by certain people.

We have a legitimate interest in using information we collect to customize your The Beck experience based on your offsite behavior. For example, if you visit websites that sell electric guitars, we may suggest a guitar sale to you. When we identify your interests based on your offsite behavior with cookies, we will obtain any consent we may need.

In addition to the specific circumstances above, we’ll only use your information with your consent in order to:

  • Send you marketing materials by email, text or push notification, depending on your account or operating system settings. Each time we send you marketing materials, we give you the option to unsubscribe.

  • Identify your location and customize the content we show you.

We’ll also rely on your consent where we use cookies to:

  • Identify you across different browser sessions. This means if you log into The Beck from your phone (or any device), we’ll remember that you’re you and you won’t need to enter your login details each time you visit The Beck.

  • Show you ads you might be interested in. We use cookies to identify your interests based on your offsite behavior. We do this for existing users and for new users, and it helps us customize the new user experience.

To find out more about how we use cookies, and your choices about how we use them, please see our Cookies Policy.

  • We use the information we collect to provide the Service to you.

Our mission

Our mission at The Beck is to help people discover the communities around them.  We believe promoted content can play a big role in helping people explore the businesses around them, which is why we want ads to be some of the best stuff you see on The Beck. If you follow these guidelines, you’ll be all set for promoting great content on The Beck.

Be authentic with our users

Authenticity means being truthful and honest about the product or service you’re promoting. It also means being transparent with people about what they should expect when they interact with your products or services.

Be respectful with your targeting

Make sure your targeting is relevant. It’s never okay to target people in a way that implies you’re aware of sensitive info about them.

Be clear about the destination

We care about the ad experience from start to finish—including the URL your ad links to. We want to make sure users find what they’re looking for when they click through.  Don’t send people to low quality landing pages.

Be responsible with your content

We don’t allow certain categories of ads because they can be disruptive or problematic, regardless of context. As always, you’re responsible for the content you promote on Pinterest, as well as the safety and trustworthiness of the products and services you offer. We never allow ads with: Adult products and services, Clickbait, Illegal activity, Illegal or recreational drugs, Imitation or counterfeit goods, Live animals and products from endangered or threatened species, Online gambling and lotteries, or games of skill, Nudity, Pharmaceuticals, Sensitive content, Weapons, Alcohol, Gambling.

You need to make sure your ads follow our standard ad guidelines and any country-specific guidelines. You need to follow all applicable local laws, regulations and industry codes for any area your ads will be shown in. You must also follow our community guidelines, terms, and the above advertising guidelines. These advertising guidelines apply to all parts of your promoted content, including the image, description and destination—and they apply to features like audience targeting.

We reserve the right to reject or remove any ad that negatively affects our relationship with people on The Beck or that goes against our interests. We may also remove ads or categories of ads that get lots of negative feedback from people on The Beck. These rules may change at any time.

Reciprocity Agreement

As a Beck Business advertiser, you agree to place a ‘Beck Badge’ on your website which helps spread the word, both visually, and with SEO (Search Engine Optimization) and helps The Beck to rank higher on search engines.  Help us, Help you!
